Will 19x8.5 19x9.5 fit without modification on a 2007 328i sedan.

Absolutely, recommended offsets for those widths would be +35 to +40 on the front and +38 to +45 on the rear. Anything around those values should fit fine.

The offset is +38 on both front and rear. What size tires would I need to get to stay away from rubbing?

235/35R19 and 265/30R19 would be rub-free fitments.
