One is SULEV the other would be ULEV.

Easiest way to tell is your car window sticker. Basically, SULEV is super ultra low emission vehicle which meets California smog control standards, BMW is increasing percentage of SULEV equipped vehicles to meet requirements of several states that are going to SULEV compliance. NY, NJ, CT, MD, VT & a few other North Eastern States are going SULEV. It does not mean (at this time anyway) that all vehicles from a manufacturer needs to be SULEV compliant, just a fleet average. This might change (not sure) for 2012 in places like NY.

Main difference is SULEV equipppment being able to reduce amount of vapors being emitted into atmosphere.

SULEV emission warranty in states listed above is 15 years 150k miles.

Good information above. The chart below further describes differences in the N51/N52:

There are three versions of the N52: N52B30O1 (High Output 260HP), N52B30M1 (Medium Output 230HP), N52B30U1 (215HP). The first two are applied for US-spec cars (E90 328 gets the N52B30M1, the outgoing X3 3.0si used the N52B30O1).
