Going for HPFP recall with mods in an out of warranty car?
So hypothetically speaking if my HPFP fails tomorrow and I go to dealership with mods in can they refuse the service? Car is out of warranty anyway, so they can't void it. I only have Procede and DCI's.

Of course they can refuse. If they can show (not easy of course) that the mod contributed to the failure then they have an obligation to deny warranty service.
A warranty extension doesn't mean that they will fix it under all circumstances |

If no codes are being thrown use Chevron Techron fuel injector cleaner (concentrate). It solves rpm fluctuating upon cold start-up. Also, for most BMW problems start off by scanning your car with the Peake Research Tool. It contains the actual BMW codes. If you want to register a newly installed battery for free (just buy a $10 cable) and google/download BMWLogger

I myself heard at least 5 cases where people's cars would just lock all 4 wheels while driving on a highway doing 70mph. So it's nothing to sneeze at. Since the cars are so old (last one was made in 1999) and respond extremely well to mods ($2000 and you have 500AWHP) there's not a lot of stock cars out there and Mitsubishi refuses service left and right because of the mods. Even something trivial like an open air filter which takes 5 minutes to install on that car. |

If the OP gets the software update now (he'll need to remove his modded software for that) then the recall is done. Future HPFP issues can be blamed on his mods if the dealership believes they contributed to the failure. |
