I would tend to say "That is an incorrect/improper use of grammar". Grammar is a syntactical concept, defined by rules, that no particular individual possesses. Instead, one makes use of the rules of grammar as a means toward understandable communication. Therefore, one doesn't "have" improper grammar, but rather does not use the rules of grammar properly. The use of the word incorrect as a substitute for the word improper when used indicate that an individual does not properly make use of grammar is acceptable IMO.

If I were forced to choose, I'd tend toward "improper". i.e. "That paragraph contained improper grammar."

anyway, why i took a poll...

girlfriend of mine filled out one of those stupid facebook polls and tagged me in it, don't know why. long story short, one of the questions was "what's your biggest annoyance?" she wrote incorrect grammar, so i happily doled out some ownage. jh valley wanted to argue that incorrect grammar was correct, so i setup this poll to pwn him, too.

You say something is "grammatically incorrect", not "grammatically improper." "Improper grammar" and "Incorrect grammar" are both widely used (Do a Google search).
