My 335i's warranty has been voided. Need Help

Just wanted to share and would be great to hear some advices. Anyways, I have chipped my car with AA for almost a year. The car was running great for about six months. Then when summer came around, everytime I go over 60mph "Engine Malfunction" pops up all the time. Thus I haven't been able to go fast.

Just a week ago I took the chip off and it's still doing the same thing. I brought my car to the dealer today and after half a day the guy called me back to let me know that my car's warranty has been voided and that they couldn't and wouldn't do anything to my car for liable reasons. I told the guy I would pay for them to fix it, but he gave me the same answer.

So... I think I'm screwed. Anyone with the same problem or could tell me what to do or where to bring the car??

I'm confused.

You took the chip OFF before taking it to the dealership right? What reason did he give you for the voided warranty? What proof?

i think all error codes from mods are stored in our keys.

What I learned is having a CA, it stores the information only if you put the key in the slot. Went to the dealers and many times they told me to at least put the key in the slot before I come in.

Ask them to explain exactly why they are voiding the warranty and go from there.

If they have proof you modded, such as from spliced wires, or logs showing increased boost etc you might be out of luck

well unless he took the chip out the wrong way and not waiting 30 minutes before the car turns off itself.. then it will be stored in the memory..

I think it somehow works with the BMW Assist. There is a 6.0 (BMW beat Infiniti on this one) megapixel camera under the hood that uploads a video to You Tube, and at the same time, a rep gets a link at BMW Assist. The rep views the video and determine if a mod was performed.

Warranty issues aside, if you are willing to pay for repair why go to an independent BMW specialty shop? Use BIMRS.org to find a "good" one in your area. They should have the diagnostic equipment necessary to accurately read the engine codes. These diagnostic machines are very expensive so the mechanic should be proud to show you his when you ask.

Not having to worry about boost, chips, high pressure fuel pumps, and limp mode...I don't have much experience in this.

I would start with Active Autowerke....then find another dealer. The law is on your side, dealers must prove that a modification caused said failure in order for it to not be covered by the warranty.

I live in Los Angeles. I went to Santa Monica BMW. Their reason was just that I have put after market components in my car and would not take any liability on fixing it.

Definitely remind them about this:
US Code - Title 15, Chapter 50, Sections 2301-2312

Legally, a vehicle manufacturer cannot void the warranty on a vehicle due to an aftermarket part unless they can prove that the aftermarket part caused or contributed to the failure in the vehicle (per the Magnuson Moss Warranty Act (15 U.S.C. 2302(C))

I agree that you should remind them about this, but that doesn't mean they can't argue with you about it and drag their feet for months and generally make it a pain in the ass to work with them. If you really want to scare them with this, you need a lawyer to send them a letter explaining it... Good luck...

What exact aftermarket components are they claiming you put in your car.
They can't just void your warrenty because they don't want to take any liability. . .
