Rolling Smog Checkpoint Watch
Hey guys/gals.
I've seen two rolling smog check points. They were both in San Diego on Washington Street in Mission Hills. Anyone else see any recently? I saw them pulling in cars going by and hooking up sniffers. Luckily I was going opposite direction.

I've read online drives have the right to refuse participation at these check points. Is this true? Can someone share their knowledge or experience with subject?

another one in san dimas on badillo st near 57. maybe once a week.
so far they let me pass without inspection as the car still looks pretty new.

The checkpoint are a violation of your 4th amendment and 10th if I recall correctly.

they do them a lot in Lemon grove area too. They will pull you in if your car looks/sounds modified and check for illegal parts (parts w/o carb no.)
Out of state plates helps |

the suspicion of an illegally modified vehicle that is not within the states' compliance is enough reason.

But they must have that suspicion prior to the stop. Random stops are without suspicion therefor unlawful. If they say "hello, we pulled you over because we heard your louder than normal exhaust coming up the road" you are screwed. If they say, "random check, you have been selected", repeat what I said above.

The random stop is just that. The ones I have seen and been through they literally walk out/point at you and direct you into the lot.
But yes as far as the random check part, you are correct. Just wanted to throw a caveat as well, don't want someone to take one statement as bible. lol |

Ive seen cars get pulled at these things, cause of being to low, then they pop the hood.. next thing you know your car is goin to the state refs and that is when the situation spirals fast....its terrible.

they would make more money cruising the highway and getting dickheads for cruising in the left lane... one of biggest pet peeves compared to the east coast man, seriously.

I saw one in Santee a few months ago and couldn't believe my eyes. Driving an e36 for 20 years, I get bad vibes just seeing Smog Check signs. Rolling up on a CHP cruiser and a mobile smog roller was stomach-churning.
It was almost like a DUI checkpoint, with a lane coned off for the test bed. The CHP officer was watching oncoming traffic, picking out the next victim. Creepy. I've rehearsed my speech for if/when. I hope I never have to see if it works. |
