Will this old lady be honest?
Ok guys want to ask your opinion on a very minor ding I had a few days ago.
While waiting for gas a Subaru wagon rolled back into the driver's side front corner of my car, causing very minor damage. The old lady who did it and I exchanged insurance details (smartphones with cameras so useful for this these days!) but as it's so minor neither of us wanted to involve insurance. I got a quote for repair (it was about $300 inc. rental for me for 2 days) and she said she would pay me by sending me a check after I send her a photo of the repaired car. My car is currently being fixed and I should get it back tomorrow. What do you think will she actually pay up? If she refuses is there really anything I can do? I think she will she was a nice lady but who knows these days... |

I had something similar happen a while ago, where my car was hit from behind at low speeds while I was stopped. The total cost of damage was $400.
I didn't want to go through any hassles since I was completely not at fault (and other driver admitted it to me) so I got a policy report and filed a claim Hope it ends well for you |

If it were me, I'd have her pay as soon as you get a quote for the damage. Whos idea was it to have you fix, and then send pic? seems fishy to me.
If she damages your car, have her pay the cost of the damage regardless of you want to fix or not. Thats my take on it. |

I guess I would have had her call the shop doing the work and have her put a credit card on file with them. However it was only $300 so why not just pay for it and move one. The old lady probably needs the $300 more than the body shop. -- just saying.

When you remove all assumptions that arise from the concept of "respect your elders", the sad truth is that a dishonest 30 year-old will likely still be dishonest at 65. Nice or not, don't end up getting ripped off just because the lady wasn't young. Old people are just as likely to be asshats as young people, but they may have learned to hide it better!

If she really does not want to go thru insurance, tell her she needs to send you a check now based on the estimate or you will go thru insurance. Not to be mistrustful, but you never know. Once fixed on your dime she can easily refuse to pay and then when you try to go thru insurance they will give you crap for getting it fixed without filing a claim in the 1st place.
That being said, if she is honest and does not want to to effect her insurance, she should pay based on the estimate. Done. Finsihed. Doesn't matter if you actually fix the car or pocket the cash. She did the damage To show there are some honest folks, on my way between offices a few weeks ago my F31 was rear ended by a dude in a pickup. He stopped right away. Asked if I was ok and if anybody else in the car (was just me) was hurt. Exchanged info right away. He owns a used car lot nearby and wanted to pay to fix my car as to avoid going thru insurance and having the rates for all his dealer plates go up. I was dubious and had to get back to work so I took his info and insurance info, took photos, and said I would call him that evening. My bumper cover was gouged and cracked and to me looked like it would need replacing. I called him that night. He again expressed wanting to fix my car. We agreed that I would take to to a local body shop, he would come with me, and would agree to pay them directly otherwise no go. He did. Car fixed. Good as new. He paid them. All done. My repair is guaranteed. So, there are some honest folk out there. Worthwhile to give them a chance but have to protect yourself too! |

no police report or a written note with her signature admitting fault or claiming responsibility (from Judge Judy), no proof, so if she doesn't pay, which i doubt she will, nothing you can do about it, the same with a door ding, that's why people aren't afraid to ding other ppl's cars, because most police will not come to deal with that stuff ... i had a person who just gave me the middle finger and then just drove off when I confronted them about them dinging my car with me in it ... it's weird that you can get arrested and jailed for stealing a $2 candy bar, but causing $300 damage to another person's car, nothing can really be done about it ...
moral of the story - get her to write down all her info on a note admitting fault with her signature and then that's your proof in case you need to pursue it in court or with her insurance company .... Last edited by dt23; 07-12-2014 at 06:37 PM.. |

Don't trust anyone. Way too many people are not as honest as they seem. Even if they had all intentions of paying, the cost of fixing the damage can greatly exceed their initial expectation, and you might see them change their mind. I had an accident happen to me and while minor, it cost almost 3k to fix. The woman who caused it due to cell phone use, wanted to avoid insurance. I still used her insurance. I'm pretty sure it will cost her less long term than if she had paid the 3k......

IMO it's always a good idea to get a police report. You don't have to go through insurance if the other person is willing to pay but in case he/she doesn't, you have everything documented. Call 911 and explain to the police officer that even a minor damage on a BMW is always more than $500.

Well thanks for the advice guys, got the car repaired quickly and easily, and sent invoices and photo to the old lady, she has said she will send me a check.
If she doesn't I will probably just let it go but it will be a nice bonus if she turns out to be honest... |

The numerous times my car was hit, I just called up the at-fault person's insurance, and made a claim directly with them. Most of the time its Geico, and I've never had an issue with them disputing the claim, with or without a police report.
