BMW Buyback

Hey bimmer fans,
I have been having quite a bit of electrical issues with my F30 and I think it is just about time I filed for a lemon law buyback. For those who have gone through this train wreck what was the process like?

How can I get a hold of BMWNA regarding this matter, as I want to solve everything in house and not resort to hiring a lawyer.

The car does qualify as a "lemon" under California law.

It's simple. I would first send bmwna an email documenting the issues and why you feel the car is no longer practical to keep. A representative will call you within 48 hours and ask you few questions. Then a case manager will be assigned to investigate the claim and service records.. Etc. After the file is complete, the case will be transferred to a bmw committee who will take a decision (all this can happen in 3 weeks). If the decision in your favor, the case manager will request financial paperwork and then give you an offer (another two weeks).

I've dealt with this. Took 5 months of back and forth with BMW. Go through the state. You'll be glad that you did. You shouldn't have to hire a lawyer (at least in my state you don't). BMWNA handed mine off for a decision to be made through various regional directors and managers in my area (I know because I got the email chain accidentally forwarded). Based on my experience, I got a call 2 months later from BMWNA saying they've made a decision but you will have to contact your sales manager at your dealership to find out the details as they are not allowed to go over them on the phone. Not going to get into details, but I did have 2 friends who are lawyers monitor my email conversations. BMW had to end up using the state of Georgia's reasonable offset for use calculation and cut me a check, but that took an extra 3 months of conversations with them.

Note: This calculation may vary by state.

"Reasonable offset for use" means an amount calculated by multiplying the purchase price of a vehicle by the number of miles directly attributable to consumer use as of the date on which the consumer first delivered the vehicle to the manufacturer, its authorized agent, or the new motor vehicle dealer for repair of a nonconformity and dividing the product by 120,000.

The same two lawyers have been working with the Department of Consumer Affairs in Georgia to change the outdated GA Lemon Laws. If you want to know more about that, PM me. Can't get into it here.

i am starting the buyback process on my 2013 335i for various issues. my dealership is taking care of everything for me but when i got the car i put 3K down. since i only got 1 year of my 3 year lease do i get any of that back??

It depends on your state law. Here in California they use the mileage at which the first problem occurred divided by 120,000 miles and multiply that by the selling price of the car. The value that is left is subtracted from all the money that you invested in the car including down payments and monthly payments. You either receive a check or you can use that money towards the purchase or lease of your next BMW. So in your situation, as well as mine, BMW owes us a healthy return

i was told by my dealer that bmw will buy back the car can bmw only do that if its a lemon or could they just let me out early give me back 2/3 of my down payment and not reimburse me for the months since the problems started?? btw i am in new york

this will be my third pima case but thanks for the info... just want to know if whenever they buy back a car they reimburse you for the months from when the problems started or, is that only the case if its a lemon law situation

replacement 335i

bmw wants to give me a replacement car not a buy back on my 13 335i msport . I will keep ALL my same lease payment/terms but get one model year newer and can build it from scratch i also get to drive my current car until the new one is ready as long as it doesn't need to go in for another repair... doesn't sound too bad to me because i will keep the same residual on my 13 but get a 14.

thoughts???

I've gone through 2 buybacks IN CALIFORNIA ($80k X-models). My first lemon was a full buyback. BMW allowed me to order a brand new vehicle and continue driving the old one as the new one was manufactured. The day it was delivered BMW bought back my Lemoned vehicle and I started a fresh loan, paperwork, credit report, etc. on the new vehicle. Of note, BMW gave me $10k off MSRP. on a brand new VERY HIGH DEMAND vehicle for my trouble.

Second Lemon - BMW gave me a very high trade-in on the "replacement vehicle" spoken about above and I used that toward my current F30. With a bit of hassle it all worked out okay in the end.

I would NOT take the same car, just 1-year newer, as I assure you BMW "compensates" other customers (such as myself) to a far higher level. Stand your ground and tell them that you would like to remain a loyal and long-lasting BMW Customer, but you need some "goodwill" on their part to repair your broken trust in their brand.

BMW NA, seemingly loves to hear how great their vehicles are and how you'd love to remain driving one, etc. It's usually the complete opposite of what they hear from other owners in your position and it has worked VERY well for me on 2 separate occasions.

Naturally, outcomes and situations vary. But, I truly believe you can do MUCH better than a new model year.

Ask for a vehicle that has more equipment for a lower price, or something to that effect. Perhaps lower payments, etc. I assure you they don't want to loose you as a "PAYING" customer.

That's my $0.02... Great job on getting this far with them! Hang in there, it'll work out in the end!

did you go thru you dealer or did you also talk with bmwna directly. Mine is a lease so not sure if i have as many options. the dealer did say i could add a few more options (HK stero) and keep the same payment since i will keep the resdiual from my 13 and get a 14 i could make out nice at the end of the lease term? thanks for your advice!

U dont need a lawyer, call them and call ur dealership, i financed my car so what they did is they will swap with the new car, and u will owe same amount on the new one so basically they are just swapping ur cars, u just have to be on top of it and always call and dont feel like u r anoyying u should be, they bmw na are nice but the dealership is the one who might try to screw u, basically the whole process is no cost to you at all, so dont let them say otherwise good luck
