Called your dealership yesterday to see what's what. Was promised a call back but never got one. Not the best way to start off a relationship! Might have to defer to BMW of Alexandria.

We did the same thing with the i8, took 28 deposits and sold 18.

Surely they will refund a 'nonrefundable' deposit if they cannot allocate a car to you. That's silly. Clearly the idea is if you agree to nonrefundable they will keep it IF you are offered a car and refuse it. Just a way to separate serious buyers from those just taking a flyer to hold a spot in line at multiple dealers. $500 is hardly a big commitment.

I gladly gave my dealer five grand. They know I want the car. If they can't get me a car, they damn well better give the do re mi back, and I am quite confident they will. I am a repeat customer for purchases and repairs and they would be crazy to pull a stunt like that. Believe it or not, there are ethical car dealerships in the world.

Also most likely not legal in the state of Virginia. I believe you can only reclaim marketing costs toward selling the ordered vehicle. Would be hard to claim a cost if the dealership wasn't able to deliver in a timely fashion. Most (good) dealers won't even bother with that.

I actually think the non-refundable option is one more dealers should consider. One of the problems is that folks are on many lists so while someone may be spot 11-12 on a list and probably half will fall off when their chance comes to get a car so it is impossible to know what the real position is. I am on 6 lists at this time. I have an order in the bank but don't have a production number yet once I have the number I will call the other dealers and pull my name. I suspect most just leave their names on the list even though they have found an allocation or decided to go with another car.
