Is there any recalls on air bags or TSB ? If so can someone link me? I was hit by a drunk driver and car is totaled. And airbags never deployed.

The frame is even bent. So I would expect the bags to deploy

Worst part, driver was uninsured and undocumented...

In your opinion, do you think the bags should have deployed? I got hit at 55mph according to the police report.
Trying to see if I can get a case with BMW going since the guy was uninsured

Hard to believe there was an undocumented person in California.
Was he at least detained by INS for the day and sent packing?
Sorry for your situation... Very frustrating!

He was arrested, but not sure what happened from there. Cops did say he was charged with a felony count.

And you'd be surprised there's an entire community of undocumented people here. Nothing wrong with that though

And yes it's extremely frustrating, especially given the scenario.

Was sitting at a res light and bam. Cops said he was going 55 MPH and that the dude said he took "12 behind the wheel"

What's that mean? "12 behind the wheel"? Asleep?

Also, I thought airbags only deployed in front and side collisions?

Guessing 12 shots? And honestly I'm not sure, I would expect my bags to deploy since I my frame is bent, my back end is crushed. Quarter panel is warped and front was smashed also.

With all the people getting hurt or killed by their Airbags you should be happy they didn't go off ... as long as they were not needed that is. Best of Luck going forward and now at least you have a good excuse to get a 440!

edit: Or looking at your signature maybe its time for an M?

Maybe as in they looked age 12 (i.e. young) ?

From my understanding airbags deploy based on "impact" sensors in the front/side of the vehicle. I guess the question is: were those sensors triggered and airbags didn't "fire".... or were the sensors simply not triggered at all ?

Did you get some severe injury that could have been prevented with airbags and that your insurance won't cover?

The car would have been wrecked airbags or not

No way, unless you were doing 35 in the same direction. It looks bad, but if you were stationary and got hit by someone doing 55 the damage would have extended to the back seat.
The Takata airbag recall isn't because they don't work, it's because when they do the inflators can end up as lethal shrapnel.
In your case being hit from the rear is less likely to cause the airbags to inflate, because they don't offer much protection from rear impact. The impact sensors are most sensitive to head on or side collisions, where the airbags offer the most protection and the threat of injury from low speed collisions is highest.

The rear passenger seat on the driver side was pushed out a little bit. It's pretty bad, adjuster said the frame is twisted.

No severe Injuries in my car, but none of the medical is covered since the guy had no insurance.

Only the car will be covered.

It looks more like a 35 collision than a 55 though. Car is meant to absorb the impact (including damage to the frame). Airbags should only deploy on a front/side collision. They would do nothing for a car being rear-ended.

Does suck though OP....

Well my car was pushed forward a good full car length which is why i hit the car infront of me.

I agree I feel like 55 should have left more damage. However it's worst in person, the inner trunk and rear seat were trashed too lol

Sorry this happened to you OP, but insurance will cover most of the cost for a replacement. At least you and your passengers were okay as the car absorbed most of the impact. The only recall on airbags I'm aware of are for shrapnel from the Takata air bags that were used as replacements in some accident vehicles that were repaired. It looks like your car was rear ended and then rear ended another vehicle or was crushed so the rate of deceleration might not have been enough to fire the air bags. I believe the accelerarometers are on the front and side so a rear end collision won't fire the air bags, would need to do an investigation if they were defective. On another note, the adjuster may have totaled the vehicle even though it is repairable so they can take ownership of it and sell those sweet rims on eBay to make a profit on your loss. If you can't fix it and sell as salvage you could part it out and come out ahead. That's probably the reason insurance companies would rather declare a car a total loss as it is more profitable for them.

I'm assuming you carry uninsured coverage but do you not carry medical on your policy?

Front and side airbags deploy during front impact and side impact. Usually it's programed to deploy based on 1-speed(35m/h or greater), 2-weight of the person, position of the seat. During the impact seat belt pretension deploy first and within couple of m/s it sends the signal to Airbags to deploy.
1,2 must require for deployment, if this event happens and airbags did not deploy then you know it's ....

During rear impact airbags will not deploy.
