Is it under warranty

I Have an 07 jet black 328i, and the paint started to fade on the back bumper and front bumper, and now I have white spots

, Is this under warranty?

bad paint? is the infamous "soft black paint" of the e92?

I bring it to a car wash place, and let them wash it.
But still i got alot of white spots on my back bumper, and next to the fod lights in front.
