Because the only requirement it fails is the US NHTSA test/requirement and they're not going to be fixing things they don't have to for the rest of the world.
Just because it fails that test it does not mean that the car is defective nor that you're going to die in an accident, it's simply a test with a specific method in the US that it fails.
