The box in the E92 is suppose to be more responsive and twice as quick, so far I haven't noticed any reluctance to change up in D mode. In sports mode it does seem to use the throttle position as an indicator of the change up point.
Tonight I used steering wheel buttons/paddle thingies to select 3rd and then on a short straight just ripped past a Golf 2.0TDI that was not exactly hanging around.
Even I was surprised !
