If there is one nearby, I'd seek out an independent BMW specialist. The dealer is more worried about protecting their collective rears than solving you problem. An independent actually wants to resolve your problem. Going legal will cause the dealer/BMW to close ranks, and prolong your pain, as a customer. An independent will also ignore your mods, provided they are demonstrably NOT part of the problem
