This is a great opportunity to let your elected officials (in this case state officials) know you disagree with the state doing this. A well written letter (not an e-mail) will get read and normally answered. Remember these elected officials are primarily interested in staying in office (all politicial parties) so if they hear enough people complaining about this they should pressure the "emissions police".
While I don't do many mods on my cars or motorcycles I think you should have the ability to do so. I see plenty of 70's-80's "junkers" on the road in the Bay Area spewing visable exhaust (oil, unburnt fuel, and coolant).
