In theory, yes. The FIA monitors EVERYTHING and they would know this. "The car must be driven alone and unaided." Look at who the single mode operation hurt... everyone but Lewis. He is cranking pole positions like crazy. It is highly likely that he finishes at 100 or even 102 before the end of the season.
If you think that the only reason HAM is winning is that many races through manipulation alone, we can't have further conversations. It is irrational in the extreme.
RBR have a history of showing EXTREME favoritism to their number one driver...you'd do better overlaying that concept on them because it is actually factual.
Edit: His braking is superior to almost every other driver. It's his hallmark Even Jenson Button commented on it at Spa in 2010 when he saw the telemetry. He was shocked at the time of application and efficacy of the results.
