I've had this happen on my 2.0 litre petrol with 7 speed DCT. Dangerous and annoying. In very similar situations to the OP's.
It's not so bad when using the 'Sport' driving mode.
I guess it's a combination of the engine lag ( i guess the M35i lag could be even worse given that it's more power out of the same sized engine?), combined with the 'learning' of the ECU/accelerator, whatever, that seems to want to keep the gear as high as possible for fuel economy?
Ruined the driving experience of my E90 335i automatic that I owned previously.
Just wish I could have bought a manual
